This Privacy Policy is provided by NexCOBOT Co., Ltd. (“NexCOBOT”) and is designed to ensure NexCOBOT is meeting its obligations under GDPR in relation to data subjects in the EU. Some of the rights described may not apply to individuals outside of the EU.

Your privacy is important to NexCOBOT. To better protect your personal information, This privacy notice will inform you as to how we collect, use and safeguard your personal data when you visit our website.

1. THE DATA WE COLLECT ABOUT YOU:

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). 

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  1. Identity Data may include first name, last name, company name, user name, and other demographic data that you provide to us. 

  2. Contact Data includes address, email address and phone numbers.

  3. Technical Data may include your last login data, internet protocol(IP) addresses, and location. 

Usage Data includes information on how you use the website Marketing and Communications Data includes your preferences in receiving marketing from us. We do not collect any “Special Categories” of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). IF YOU FAIL TO PROVIDE PERSONAL DATA: Where we need to collect personal data by law, or under the terms of an agreement we have with you and you fail to provide that data when requested, we may not be able to perform the agreement we have or are trying to enter into with you. In this case, we may have to cancel a service you have with us but we will notify you if this is the case at the time.

2. HOW IS YOUR PERSONAL DATA COLLECTED:

We may have to share your personal data with the parties set out below for the purposes set out in the table in paragraph 4 above.

We may share Personal Information with our authorized third parties (such as our authorized vendors) who help with our business operations, including the storage and processing of personal data for the uses listed in this Privacy Policy.

  • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. 8. INTERNATIONAL TRANSFERS

NEXCOBOT is an international company, with affiliates and divisions based outside the European Economic Area (EEA). As part of our business processes, we may process your personal data by undertaking a transfer of data outside the EEA. We may also use service providers who are outside the EEA.

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.

  • Where we use providers based in the US, we may transfer data to them if they are part of the Privacy Shield https://www.privacyshield.gov/welcome, which requires them to provide similar protection to personal data shared between Europe and the US.

NexCOBOT has put in place appropriate security measures to protect your Personal Data. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee the absolute security of your Personal Data.

10. DATA RETENTION

We will only retain your personal data for as long as necessary in accordance with the above purposes and applicable laws. We may be required to retain your Personal Data for a number of years in order to satisfy legal or contractual obligations, or in order to establish, exercise or defend legal claims.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and as well as applicable legal requirements.

To the extent provided by applicable law, you may have the following rights relating to your personal information: (i) request for access or copies of Data NexCOBOT processes, (ii) rectification of incorrect Data, (iii) deletion of Data, (iv) restrictions on processing of Data, (v) portability of Data, (vi) lodge complaints with competent authorities in your jurisdiction, and/or (vii) receive a list with the names and addresses of any potential recipients of Data.
